    Why this page exists.

    Washington, Nevada and Connecticut have laws written specifically for health information held by companies that sit outside HIPAA. That is the gap we sit in, and this page is how those laws are answered. If you live somewhere else, this page still describes how we treat your health information.

    Whether HIPAA covers us.

    Most people assume anything health related is covered by HIPAA. It usually is not, once a company sits outside a doctor's office. We do not practice medicine, we do not prescribe, and we do not dispense. Prescribing clinicians are part of TelegraMD's licensed provider network and they are not our employees. Our own status under HIPAA has not been determined, and our current view is that we are probably not a covered entity. The providers who treat you and the pharmacy that dispenses your medication are covered entities in their own right.

    What we treat as consumer health data.

    The answers you give in the eligibility check, including your goals, what you have tried, what gets in the way, your age range and your state. Anything you tell us about your health when you contact support. And the fact that you are interested in a particular program.

    Where we get it.

    From you, directly. We do not buy it from data brokers and we do not collect it from social media platforms.

    What we use it for.

    To work out whether a program may be a fit. To pass to a licensed provider so they can review you. To fulfil and support what you bought. To contact you about your interest and your program. To answer you when you contact support. To understand where people drop out of the eligibility check so we can improve it. And to meet our legal obligations.

    What we never use it for.

    We do not sell consumer health data. We do not share it for cross-context behavioral advertising. We do not use it to build advertising audiences. We do not use it to make automated decisions that produce legal effects about you. And we place no advertising tag on the eligibility check and send no advertising event from it.

    The advertising tools we do run, the Meta Pixel and CallRail, are never given your eligibility answers. When you finish the check, an advertising system may be told that someone completed it. It is not told what you answered, which programme you were interested in, or anything about your health.

    Who we share it with.

    TelegraMD and its licensed provider network, who receive what a provider needs to review and prescribe. Our customer relationship system, where your answers are stored and from which our email and text messages are sent. Our payment processor, which receives what it needs to charge you and does not receive your eligibility answers. The dispensing pharmacy, to the extent your program involves it. Professional advisers, where they need it to advise us. Government or law enforcement, where the law requires it. And a successor, if the business is sold.

    Your rights.

    You can ask us to confirm whether we hold consumer health data about you, to tell you who we have shared it with, and to delete it. You can withdraw consent for us to collect or share it. Requests are free, and we will not treat you differently for making one.

    How to exercise them.

    Email support@elevatehealthrx.com with the address or mobile number you used. We will confirm it is you before we act, and we will respond within 45 days. If we need longer we will tell you why.

    If we say no.

    You can appeal by replying to our decision. If you are still not satisfied, you can complain to your state Attorney General.
